These Terms and Conditions apply to the use of the website www.belthatcraft.com and to purchases made through the Belthatcraft website.

By placing an order through this website, the customer acknowledges and accepts these Terms and Conditions. Nothing in these Terms and Conditions limits the mandatory rights granted to consumers under applicable Dutch or EU law.

  1. About Belthatcraft

Brand: Belthatcraft
Email: leather@belthatcraft.com
Website: www.belthatcraft.com

Belthatcraft sells leather belts, leather hats, and related leather accessories through its website.

Product descriptions, photographs, prices, and other relevant purchase information are provided on the respective product pages prior to placing an order.

  1. Product Information

We make reasonable efforts to ensure that product descriptions and images clearly present information about the products offered for sale.

Due to the natural characteristics of leather and variations between individual items, products may exhibit slight differences in color, texture, grain, or appearance. Provided the product conforms to the agreed description, such characteristics do not in themselves constitute non-conformity.

It is the customer’s responsibility to review the product information on the relevant product page before placing an order.

  1. Orders and Formation of Contract

Submitting an order via the website constitutes an offer to purchase the selected products.

Upon receipt of the order, Belthatcraft will send an order confirmation via email containing the relevant order details.

A sales contract is formed in accordance with applicable Dutch law once Belthatcraft accepts the order.

If an order cannot be accepted or fulfilled, Belthatcraft will notify the customer and handle any payments received in accordance with applicable law.

  1. Prices and Payment

The price applicable to an order is the price displayed on the website at the time the order is placed.

Any applicable taxes and shipping costs will be displayed before the customer completes the purchase.

Payment must be made using the payment methods provided at checkout.

Belthatcraft may take reasonable measures to verify orders when necessary for order management, compliance, or the prevention of unauthorized transactions.

  1. Delivery

Belthatcraft serves customers across Europe. Orders will be shipped via available priority delivery services (such as DHL Priority, FedEx Priority, or UPS Priority), with the specific carrier depending on the destination and applicable shipping arrangements. The standard delivery timeframe for shipments originating from the Netherlands is approximately 5 to 12 business days.

The delivery times mentioned above are estimates based on standard shipping arrangements applicable to the order. If a specific delivery timeframe has been explicitly agreed upon with the customer, that agreed timeframe shall prevail.

Delivery Tracking

Where tracking information is available, Belthatcraft may send tracking notifications to the email address provided by the customer at the time of the order.

Such notifications may include relevant delivery status updates, such as:

Order shipped;
Shipment received or processed by the logistics facility;
Shipment in transit;
Local delivery stage;
Delivery completed.

These notifications are intended to keep the customer informed about the delivery progress of their order.

  1. Delayed Delivery

If an order is not delivered within the applicable standard delivery timeframe, the customer may contact Belthatcraft at:

leather@belthatcraft.com

Belthatcraft will review the order and, if necessary, inquire with the relevant carrier regarding the shipment status.

Following an investigation, Belthatcraft will determine an appropriate solution based on the specific circumstances of the shipment and the customer’s statutory rights.

If it is confirmed that the goods are lost or that delivery cannot reasonably be completed, Belthatcraft will provide an appropriate remedy; depending on applicable law, this may include a refund or a replacement of the goods.

Nothing in this section limits any mandatory rights to remedies that the customer may have under applicable Dutch or European law.

  1. Transfer of Risk

Where Belthatcraft arranges for the delivery of goods to the customer, the risk of loss of or damage to the goods remains with Belthatcraft until the customer (or a third party designated by the customer, other than the carrier) takes physical possession of the goods.

Handing over the goods to a carrier selected or arranged by Belthatcraft does not constitute a transfer of the risk of loss or damage to the customer.

The application of this clause is subject to mandatory rules regarding consumer sales contracts.

In accordance with Article 20 of EU Directive 2011/83/EU, when a trader ships goods to a consumer, the risk generally transfers when the consumer (or a third party designated by the consumer, other than the carrier) takes physical possession of the goods.

  1. Statutory Conformity

Products provided by Belthatcraft must conform to the sales contract and applicable statutory requirements.

If a product is defective, damaged upon delivery, or does not conform to the contract, the customer may contact Belthatcraft to seek appropriate statutory remedies.

Depending on the specific circumstances, appropriate remedies may include repair, replacement, a price reduction, or termination of the contract and a refund, subject to applicable Dutch and European law.

Guidance from the Dutch government confirms that consumers who purchase products benefit from statutory guarantees of conformity; if a product is defective, the consumer may—depending on the circumstances—be entitled to repair, replacement, or a refund.

9. Damaged or Defective Goods

If the goods received appear to be damaged or defective, please contact:

leather@belthatcraft.com

Customers may provide photos showing the condition of the goods along with relevant order information.

If the information provided in the photos is sufficient to confirm the reported issue, Belthatcraft may resolve the matter without requiring the customer to return the item.

Depending on the circumstances, the resolution may involve a replacement or a refund.

If further information is required to determine the appropriate course of action, Belthatcraft may request additional details regarding the order or the condition of the product.

The handling of damaged or defective goods does not affect any statutory rights the customer may have.

  1. Right of Withdrawal

For distance contracts concluded online, consumers generally have a statutory right to withdraw within 14 days without giving any reason, subject to applicable statutory exceptions.

For sales contracts, the withdrawal period generally begins on the day the consumer (or a third party other than the carrier and indicated by the consumer) acquires physical possession of the goods.

Customers exercising their right of withdrawal must notify Belthatcraft of their decision before the applicable withdrawal period expires.

Customers may contact Belthatcraft via:

leather@belthatcraft.com

Customers may also use the statutory model withdrawal form, where applicable.

  1. Return of Goods After Withdrawal

Unless an exception applies, customers must return the goods within 14 days of notifying Belthatcraft of their decision to withdraw (and without undue delay).

The deadline is met if the goods are sent back before the 14-day period expires.

Customers generally bear the direct costs of returning the goods after withdrawal, unless Belthatcraft agrees to cover these costs or applicable law provides otherwise.

Customers are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods (subject to applicable law).

  1. Refunds After Withdrawal

If a customer validly exercises the right of withdrawal, Belthatcraft will refund the payments received from the customer in accordance with applicable law.

The refund will include applicable standard shipping costs paid by the customer; however, if the customer chose a more expensive delivery method resulting in additional costs, statutory rules regarding such additional costs apply.

In accordance with applicable EU rules, Belthatcraft may withhold the refund until the returned goods are received or the customer provides proof of having sent the goods back, whichever occurs earlier.

  1. Exceptions to the Right of Withdrawal

The statutory right of withdrawal is subject to exceptions provided by applicable law.

If a statutory exception applies to a specific product or transaction, the customer will be informed of this before placing an order.

Exceptions under applicable European consumer law include (but are not limited to) goods made to the consumer’s specifications or goods that are clearly personalized, provided the statutory requirements for such exceptions are met.

14. Cancellation

For customers purchasing via the online store, where Dutch law requires the provision of an online cancellation (return) function, Belthatcraft will provide a convenient cancellation/withdrawal mechanism in accordance with applicable regulations.

This statutory cancellation option does not preclude customers from expressing their intent to withdraw via an unequivocal statement (including by email, where permitted by applicable law).

  1. Complaints

Customers may submit complaints or inquiries regarding their orders via the following method:

Email: leather@belthatcraft.com

When submitting a complaint, the customer should provide the relevant order number and sufficient details to explain the issue.

Belthatcraft will review the complaint and provide a response based on the specific circumstances and applicable legal requirements.

  1. Limitations on Contractual Terms

Nothing in these Terms and Conditions excludes or limits any rights or remedies that cannot be excluded or limited under mandatory Dutch or European consumer laws.

Any provision conflicting with mandatory consumer protection rules applies only to the extent permitted by applicable law and does not affect the validity of the other provisions in these Terms and Conditions.

  1. Governing Law

These Terms and Conditions are governed by the laws applicable to Belthatcraft and the relevant sales contract, subject to mandatory consumer protection provisions applicable in the consumer’s country of residence (where such provisions apply).

Nothing in these Terms and Conditions deprives the consumer of mandatory protection rights that cannot be excluded by contractual agreement under the law.

  1. Amendments

Belthatcraft may update these Terms and Conditions as necessary to reflect changes in its business operations, the website, or applicable legal requirements.

The version published on the website at the time an order is placed applies to that order, subject to mandatory legal provisions.
